No Offense

Roommate Allen was out late last night and had his car parked on a residential street in Lakeville, MN. When he got back to his car there was a ticket from Dakota County but there was no offense listed. It contained his personal information, his car’s information, the location of the car and a court date if he wants to plead not guilty to… no offense. As far as he is aware, he was legally parked. He also did not get a fine schedule but did get an envelope.

    I once was yelled at by a Wright County clerk because I called in to complain about a speeding ticket that listed me as speeding in Malp [Maple] Lake, at 10 miles an hour faster than the cop actually said, at a mile marker that didn’t exist on the county road, with a court date set in the past. The cop had tagged someone else who was actually speeding and gave me the ticket because I wasn’t from the area (the time on the radar reading was an hour before he pulled us over). But he was correct - I was willing to pay rather than travel from Minneapolis to Buffalo to fight it, and the clerk was correct, I was willing to pay rather than to ever talk to her again.

    I once had a judge dismiss a court fee and two years later got a collection notice for this fee. I had saved the form where the judge dismissed the fee and brought it to the court house in dispute of the fee. They said it didn’t matter since the fee is by statute and to pay up.

    I paid wishing I had just sent the $70 check when the collection notice came rather then hours talking to these people and an hour driving to produce the form.

    It has been my understanding that if information is omitted or incorrect, you have the upper hand in getting out of the ticket but the experiences here prove that you can’t fight city hall.
